These Terms & Conditions (“Terms”) govern your use of the Mitcham Driving School website and the driving instruction services we provide. By booking a lesson, package or test, or by using our website, you agree to these Terms. Please read them carefully.
1. About us
Mitcham Driving School (“we”, “us”, “our”) provides driving instruction services in Mitcham and surrounding South Australian suburbs. Where these Terms refer to “you” or “your”, we mean the person making a booking, the student receiving the lesson, or the visitor using our website, as the context requires.
2. Bookings
- Lessons, packages and test bookings may be made via our website, by phone, or in person with your instructor.
- A booking is confirmed once we have accepted it and (where required) payment or a deposit has been received.
- You are responsible for providing accurate contact details, learner permit information, and pickup address.
- Students must hold a valid learner’s permit at the time of each lesson and must bring their permit with them.
- Students under 18 must have parental or guardian consent before booking lessons.
3. Pricing and payment
- Current prices are published on our website. Prices may change from time to time but will be honoured for bookings already confirmed.
- Payment is required at or before the time of each lesson, unless otherwise agreed. We accept the payment methods displayed on our website or as advised by your instructor.
- Package lessons must be used within 12 months of purchase unless otherwise agreed in writing. Unused lessons after this period may be forfeited.
- All prices are in Australian dollars (AUD) and include GST where applicable.
4. Cancellations and rescheduling
- More than 24 hours’ notice — you may reschedule or cancel a lesson at no charge.
- Less than 24 hours’ notice — the full lesson fee may be charged, at our discretion.
- No-show — if the student is not at the pickup location at the booked time, the full lesson fee will be charged. We will wait up to 15 minutes before considering a lesson a no-show.
- Cancellations by us — we may reschedule a lesson due to instructor illness, vehicle issues, severe weather or other circumstances beyond our reasonable control. In such cases the lesson will be rescheduled at no extra cost.
- Test bookings — cancellation policies for VicRoads or SA Department for Infrastructure and Transport tests are set by that authority and any fees they charge are the student’s responsibility.
5. Refunds
- We do not generally provide refunds for change of mind or unused lessons.
- Where a refund is provided, it will be processed back to the original payment method within a reasonable time.
- Nothing in these Terms limits your rights under the Australian Consumer Law.
6. Conduct during lessons
- Students must follow the reasonable directions of the instructor at all times during a lesson.
- The instructor may end a lesson early if the student is under the influence of alcohol or drugs, behaves unsafely, is abusive, or refuses to follow instructions. No refund will be provided in such cases.
- Smoking, vaping and eating are not permitted in our vehicles.
- Mobile phones must be silenced and put away during the lesson, except where the instructor permits use of GPS navigation.
7. Safety and dual controls
Our vehicles are fitted with dual controls and our instructors are accredited to teach learner drivers. The instructor remains in control of the vehicle at all times and will intervene where necessary for safety. Lessons are conducted in accordance with road safety laws and best practice driver training methods.
8. Insurance and liability
- Our vehicles are insured for use during driving lessons by accredited instructors and learner drivers under instruction.
- To the maximum extent permitted by law, our liability for any loss or damage arising from our services is limited to the cost of the lesson or package giving rise to the claim.
- We are not liable for indirect or consequential loss.
- Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy under the Australian Consumer Law that cannot lawfully be excluded.
9. Use of our website
- Content on this website is owned by Mitcham Driving School or used with permission. You may view and print pages for personal, non-commercial use, but may not reproduce, republish or distribute content without our written consent.
- You agree not to use the website in any way that is unlawful, fraudulent, or harmful to other users, or that interferes with the operation of the site.
- We try to keep the website accurate and up to date but make no warranty that information is complete, current or error-free. Prices, services and content may change without notice.
10. Third-party links
Our website may link to third-party websites (for example licensing authorities or social media platforms). We are not responsible for the content, accuracy or practices of those websites.
11. Privacy
Personal information we collect is handled in accordance with our Privacy Policy, which forms part of these Terms.
12. Changes to these Terms
We may update these Terms from time to time. The most recent version will always be available on our website with the “Last updated” date at the top. Bookings made after the update are subject to the updated Terms.
13. Governing law
These Terms are governed by the laws of South Australia. Any dispute arising under or in connection with these Terms is subject to the exclusive jurisdiction of the courts of South Australia.
